The slip-fall, a mainstay of slapstick comedy, is as old as Vaudeville itself - a man slips on banana peel, lands on his rump and the audience bursts out in laughter. It becomes a whole other issue, however, when slips and falls occur in the workplace. So whose responsibility is it?
Interestingly, in the case of many non-toxic materials, there are no protocols in place mandating the level of spill response training that a facility absolutely has to have. It is expected that a facility will provide a sufficient response to an emergency-including the timely placement of a temporary berm or hazardous spill berm -based on the circumstances pertaining to that particular facility. Mitigating factors would include, but not be limited to, the amount of chemicals, oils, solvents, or water on a project or contained in a machine prone to spillage, and the facility's proximity to outside help should a spill occur. In most cases, it falls upon the operations manager to decide what a "sufficient" response to a spill is for the facility, how many and what type of spill containment berms should be placed, and what level of training should be maintained by spill responders.
